Rankin Biomedical Corporation products are guaranteed to be free from defects in material and workmanship and to perform per manufacturer’s original specifications. The warranty terms within the sales contract prevail, if they differ from this document.

Warranty Period 

  1. Rankin-refurbished products sold and operating within the USA come with a full warranty of 1 year on parts and labor to the first user of the products beginning on the Warranty Start Date*. 
  1. Rankin-refurbished products sold and operating outside of the USA, come with a warranty of 90 days on parts only.
  2. New products sold by Rankin Biomedical are warranted by the applicable manufacturer.

Warranty is subject to the following

Service Hours 

  1. Timing of the service will be performed at mutually agreeable times worked out by both parties and will be during normal working hours (8:00 AM to 5:00 PM), Monday through Friday, holidays excluded. Customers requesting service outside of normal working hours will be charged at 100% of the published service rates then in effect and will pay for travel and labor time.

Site Approval 

  1. An initial site survey may be undertaken by a Rankin Biomedical representative to determine if the Customer site meets all environmental and electrical specifications for the equipment, as prescribed by Rankin Biomedical. If, at any time during the term of this agreement, the site does not meet Rankin Biomedical specifications prescribed for the equipment, Rankin Biomedical’s obligations hereunder will be suspended until the site satisfies such specifications. In the event the Customer moves the equipment, or any part thereof, from the site, Rankin Biomedical reserves the right, in addition to any other rights it has with respect to the site approval, to impose a re-installation charge for any additional site survey costs incurred by Rankin Biomedical. If Rankin Biomedical is required to perform any special services that are needed to restore the equipment back to its intended purpose, and which are not of Rankin’s doing at the Customers site, the Customer will be invoiced for these special services rendered. Invoices shall be due and payable within thirty (30) days after the date of the invoice. Past due invoices will carry a late charge of 1 1/2% per month.

Rankin Biomedical Corporation Responsibilities 

If a defect in material or workmanship is found during the warranty period, Rankin Biomedical Corporation or one of its designated third-party service providers or other provider approved by Rankin Biomedical Corporation will: 

  1. Provide new, remanufactured or Rankin Biomedical Corporation approved repair parts or assembled components, at Rankin Biomedical Corporation’s choice, needed to correct the defect. All replacement parts provided under the terms of this warranty are warrantied for the remainder of the warranty period applicable to the product in which the parts were installed, as if such parts were original components of the Rankin Biomedical Corporation product. (NOTE: parts replaced under warranty become the property of Rankin Biomedical Corporation). 
  2. Reserve the right to perform repairs and services onsite or remove the product from Customer’s site to be taken to Rankin Biomedical’s facility in Holly, MI. 
  3. Replace service items made unusable by the defect. 
  4. Provide reasonable or customary labor needed to correct the defect, including lab for removal and installation when necessary to make the repair for the Rankin Biomedical Corporation product warranty period as stated above. 

Excluded from this coverage under this agreement are services and parts required as a result of: 

  1. Customer abuse, misuse, neglect, accident, or other causes beyond Rankin Biomedical Corporation’s control; 
  2. Modifications or attachments to the equipment without prior written authorization from Rankin Biomedical Corporation; 
  3. Service of the equipment by other than Rankin Biomedical Corporation personnel without prior written authorization from Rankin Biomedical Corporation; 
  4. Use of software not approved in writing by Rankin Biomedical Corporation.

User Responsibilities 

During the warranty period, the user is responsible for: 

  1. Providing proof of the warranty start date, as the first user. 
  2. Labor costs, except as stated under “Rankin Biomedical Corporation Responsibilities”.
  3. Local taxes, if applicable.
  4. Costs to investigate complaints, unless the problem is caused by a defect in Rankin Biomedical Corporation material or workmanship.
  1. Giving timely notice (within 24 hours) of a warrantable failure and promptly making the product available for repair.
  2. Performance of manufacturer’s required maintenance and documentation of such, written in the Maintenance and Repair Log.
  3. Prompt submission of electronically stored data and Maintenance and Repair Log when requested by Rankin Biomedical Corporation.                                            

Limitations

Rankin Biomedical Corporation is not responsible for failures resulting from: 

  1. Any use or installation which Rankin Biomedical Corporation judges improper. 
  2. Attachments, accessory items, and parts not sold or approved by Rankin Biomedical Corporation. 
  3. Abuse, neglect, and/or improper repair. 
  4. User’s delay in notifying Rankin Biomedical Corporation of a problem, continuing to operate the machine with an evident problem, or making the product available after being notified of a potential product problem.
  1. Unauthorized repair, adjustments, or unauthorized setting changes.
  2. Using consumables or components that are expired or heavily worn.

*The Warranty Start Date is the date commissioned by an authorized Rankin Biomedical Corporation representative, or if not commissioned, not later than 2 weeks from the date shipped to the end user. The Warranty Start Date for new or refurbished replacement parts, accessories, and components sold separately is the date of shipment to the end user.

NEITHER THE FOREGOING EXPRESS WARRANTY NOR ANY OTHER WARRANTY BY RANKIN BIOMEDICAL CORPORATION, EXPRESS OR IMPLIED, IS APPLICABLE TO ANY ITEM RANKIN BIOMEDICAL CORPORATION SELLS, WHICH IS WARRANTED DIRECTLY TO THE USER BY ITS MANUFACTURER.

THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, REMEDIES UNDER THIS WARRANTY ARE LIMITED TO THE PROVISION OF MATERIAL AND SERVICES, AS SPECIFIED HEREIN. RANKIN BIOMEDICAL CORPORATION IS NOT RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

RANKIN BIOMEDICAL CORPORATION EXCLUDES ALL LIABILITY FOR OR ARISING FROM ANY NEGLIGENCE ON ITS PART OR ON THE PART OF ANY OF ITS EMPLOYEES, AGENTS OR REPRESENTATIVES IN RESPECT OF THE MANUFACTURE OR SUPPLY OF GOODS OR THE PROVISION OF SERVICES RELATING TO THE GOODS.
